AN ORDINANCE AMENDING THE TEXT TO CHAPTER 31 AND ORDINANCE 183 AT SECTION 12 CONCERNING THE AGRICULTURAL-COMMERCIAL ZONE.
Be it ordained by the governing body of the Village of Los Ranchos de Albuquerque, hereafter “the Village”; and
The governing body is authorized pursuant to § 3-21-1of the NMSA to adopt zoning ordinances; and
The governing body finds it necessary, desirable and in the best interest of the Village and its residents to amend the zoning ordinances and this amendment conforms with and furthers the goals of the 2010 Master Plan.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE

B. ADDITIONAL REGULATIONS
AMEND:
(1) Retail uses may not exceed 500 1,000 sq feet of floor space in lots <5 four (4) acres or less. A maximum of 750 2,000 sq feet is allowed on lots exceeding 5 4 acres.
AMEND:
(5) Hours of operation: Retail sales are limited to 5 7 days/a week, and may begin not earlier than 9 AM and must end by 6 PM, unless a special use permit is in effect unless a special event is taking place.
C. SPECIAL EVENT
(1) Permissive Events
AMEND:
(a) 50 persons plus up to 7 employees, occurring no more often than four (4) eight (8) times in a calendar month and four (4) events per calendar month with up to 150 persons plus 11 employees beginning no earlier than 8 AM and ending prior to 11 PM are permissive in the AC zone, provided that adequate off-street parking is available and the property is fully in compliance with the requirements of this ordinance and all other applicable regulations of the Village of Los Ranchos de Albuquerque.
AMEND:
2. Special Event Permits (SEP)
All other special events, not covered under C(1) require the issuance of a Special Event Permit by the Village Administrator.
DELETE:
3. Events requiring SEP:
All other special events require the issuance of a Special Event Permit (SEP) approved by the Planning and Zoning Commission.
F. CONDITIONAL USES
DELETE:
(5) Special events at wineries or other permissive activities as set forth in Section A with specific parameters placed upon those activities at the time the conditional use is received. Enlargements of those special event parameters may be given by the Village on a case-by-case basis on application to the Planning and Zoning Commission at least forty-five (45) days prior to the event.
AUTHORITY. The Director of Planning and Zoning is hereby given the authority to interpret and implement this Ordinance.
SEVERABILITY. If any section, subsection, paragraph, sentence, clause, phrase, or part hereof is for any reason declared unconstitutional or invalid, the validity of the remaining portions hereof shall not be affected since it is the expressed intent of the Board to pass each section, subsection, paragraph, clause, phrase and every part thereof separately and independently of every other part.
EFFECTIVE DATE, REPEAL, AND PUBLICATION. This Ordinance shall take effect and be in full force five days after adoption of this Ordinance.
COMPILING CLAUSE
This ordinance shall be incorporated and compiled as part of the codified ordinances of the
